Axminster Tools Extended 2-Year Warranty

1. Background

1.1 Definitions

• “We / we”, “Us / us”, “Our / our” – means Axminster Tools, Unit 10, Weycroft Avenue, Axminster, EX13 5PH, registered company number 03326979
• “Extended Warranty” – means the cover provided in clause 2 of this document for the Laguna Product
• “Price” – means the agreed payment made by You to Us in consideration to this Extended Warranty
• “You / you” – means the person that has purchased the Laguna product and the Extended Warranty
• “Product” – means the Laguna Product purchased from Us and with which this Extended Warranty has been purchased.

1.2

To purchase the Extended Warranty, you must pay the Price at the time of purchasing the Product. An Extended Warranty cannot be purchased after the date of the original invoice for the sale of the Product.

1.3

An Extended Warranty cannot be purchased if the original invoice was not issued by Us.

2. Guarantee

2.1

We guarantee that for a period of 2 years from the original invoice date that the Product shall:

• be of satisfactory quality;
• be fit for any purpose we say the Goods are fit for or for any reasonable purpose for which you use the Goods;
• be free from material defects in design, material and workmanship
• comply with all applicable statutory and regulatory requirements relating to the Goods in the United Kingdom.

2.2

We will repair or replace, at no cost to You, any part/s which are proved to be faulty in accordance with paragraph 2.1 provided that:

• 2.2.1 You follow the claims procedure set out in clause 3 below; 2.2.2 You have purchased the correct product for Your intended purpose;
• 2.2.2 You have purchased the correct product for Your intended purpose;
• 2.2.3 We are provided with a reasonable opportunity, after the claims procedure has been followed, to examine the Product. It is at Our discretion as to whether we need to examine the product before issuing any parts free of charge;
• 2.2.4 Where We determine examination is necessary, You agree to return the Product to Us or allow a member of Our team to visit the place where the Product is installed to allow the examination to occur;
• 2.2.5 If the product is a dust extractor and We have deemed that an examination is required, either by returning the Product to Us or We send a member of Our team, then the Product must be cleaned thoroughly by You before any examination can occur;
• 2.2.6 Any fault identified is not as a consequence of: - the Product being used for a purpose that which the Product is not suitable - Issues identified due to misuse and neglect
• fair wear and tear that can be reasonably expected throughout the life of the Product including items such as drive belts and bearings and consumables such as blades and other wearable parts (see schedule 1 which provides a non-exhaustive list of Laguna Products and the parts that are considered wearable) - operating the Product with consumables that are blunt and/or incorrect - modifications made by You that are not supplied as standard with the Product.
• 2.2.7 You have maintained and serviced the Product in accordance with the instruction manual and any other industry best practice guidelines.

3. Claims Procedure

3.1

Firstly, please contact Our customer services team and discuss the Product with US. This must be done within 48 hours of identifying any potential fault with the Product.

3.2

If it is agreed that there is a potential fault with the Product then You are required to write to Us providing Your proof of purchase, images that best highlight the potential fault and an explanation of the problem that has led to the fault.

4. Limitation of liability

4.1

This Extended Warranty is an added benefit that is purchased by You at the agreed Price and only applied to the Laguna Product that You purchased alongside this Extended Warranty.

4.2

This Extended Warranty, and these terms and conditions, does not confer any other rights other than those expressly set out above. All other terms and conditions can be found on Our website at Terms & Conditions | Axminster Tools.

4.3

This Extended Warranty is in addition to Your statutory rights.
